VA & FHA Foreclosure Rules Just Changed. Florida Condos Are Out of Grace Periods. Here's What It Means for Your Buyers and Sellers.

Two things changed this cycle that every South Florida agent needs on their radar — not because they're dramatic, but because your clients will ask you about them before you've had time to read the fine print. So let's get you ahead of it.
1. VASP Is Gone. The New VA Partial Claim Program Is Live — But It Doesn't Do What Most Agents Assume
For years, VASP (Veterans Affairs Servicing Purchase) was the safety net when a VA borrower fell behind — VA bought the delinquent loan and modified it to a fixed 2.5%. That program ended May 1, 2025. Its replacement, authorized under the VA Home Loan Reform Act, opened for submissions on June 15, 2026, and servicers have until November 28, 2026 to fully implement it.
Here's the part agents keep getting wrong: this is not a rate-reduction program. VA can now purchase up to 25% of a delinquent loan's unpaid balance (30% if the borrower already used a COVID-era partial claim), and the veteran repays that portion over 5 years, interest-free. That lowers the principal a servicer is chasing — it does not lower the borrower's monthly payment on the remaining loan.
Why that matters: under the new loss-mitigation waterfall, a veteran only qualifies for a lower modified payment if their original note rate is higher than today's market rate — a rare scenario with most legacy VA loans sitting well under 5% and today's rates near 7%. For a borrower who genuinely can't afford the payment, the honest options are still limited to a repayment plan, a short sale, or foreclosure.
What this means for you: if you're working with a veteran client who's fallen behind, don't tell them "there's a new program that will fix this." Tell them the truth — that the new partial claim program helps in specific situations, and if it doesn't fit theirs, a short sale conversation early is far better than waiting for a default notice. That's the agent-as-guide move: connect them with a HUD-approved housing counselor or their loan servicer's loss mitigation department before the timeline runs out on them.
2. Foreclosure Filings Are Up 21% — And Florida Is a Named Hot Spot
ATTOM's mid-year 2026 report shows 227,548 properties with foreclosure filings nationally through June — a 21% jump from the same period last year and up 28% from two years prior. Florida, South Carolina, and Indiana are called out specifically as hot spots. One industry executive has gone as far as predicting FHA and VA foreclosures could more than double by next fall.
Some of this is a correction, not a crisis — pandemic-era leniency artificially suppressed FHA foreclosures for years, and that pendulum is swinging back to normal activity. But it's still real inventory hitting the South Florida market, and it's another data point supporting what we've said on the show before: this shift toward a buyer's market is being driven by rising inventory and longer days on market — not falling rates. Rates are still sitting near 7%.
On the FHA servicing side, HUD's Mortgagee Letter 2026-03 also revised the bidding process for foreclosure sales (CWCOT), mandatory for sales scheduled April 29, 2026 and after — relevant if you have investor clients bidding at FHA foreclosure auctions.
3. SIRS Grace Period Is Over. This Is Now a Liability Issue, Not a Compliance Reminder.
As of January 1, 2026, Florida condo associations three stories and up can no longer waive or underfund reserves for the 8 SIRS-mandated structural components — no owner vote can override that anymore. If your buyer is looking at a building that hasn't gotten the memo, that's not a minor red flag. It's a financial exposure they're about to inherit.
What's changed since we last covered this: enforcement has teeth now. Under Florida Statute 718.111, a board's failure to fund SIRS reserves is increasingly being treated as negligence per se — meaning the failure itself is evidence of negligence, no additional proof needed. D&O insurance typically excludes willful violations, which means individual board members can be personally exposed. And under HB 1021, associations with 25+ units now have to post governing documents, budgets, and reserve studies publicly.
Before your buyer writes an offer on any condo 3+ stories, get these three documents:
- The milestone inspection report
- The completed SIRS
- The current reserve study and funding plan
Industry estimates suggest more than half of eligible Florida condos still weren't SIRS-compliant as of early 2026. That's not a reason to scare your buyer off condos — it's a reason to be the agent who actually reads the documents before they fall in love with the view. Suggest they get a structural reserve study review from a licensed professional, and be present when they get the answer.
The Bottom Line
None of this is cause for alarm — but all of it is cause for precision. Veterans need honest answers, not false hope. Buyers need the real documents, not a listing agent's reassurance. And every agent repeating "rates are falling" as the reason for a shifting market is telling clients the wrong story. Get the facts right, and you become the agent people trust when the market gets confusing — which is exactly when they need you most.

Y todo agente que repite "las tasas están bajando" como la razón del cambio de mercado le está contando a sus clientes la historia equivocada. Ten los datos correctos, y te conviertes en el agente en quien la gente confía cuando el mercado se pone confuso — que es exactamente cuando más te necesitan.
